IP Attorney

 

IMPACT and OPPORTUNITY

Support the corporation’s leading market position and business plans by protecting the corporation’s intellectual property, assisting in securing commercial agreements and providing other general legal services.  

 

ESSENTIAL FUNCTIONS AND RESPONSIBILITIES

 

  • Assess corporate inventions for patentability and strategic merit.
  • Determine where to file foreign patent and other intellectual property applications.
  • Assist in developing intellectual property strategy and policies.
  • Engage and supervise outside legal counsel on intellectual property matters, including patent and trademark prosecution and intellectual property litigation.
  • Ensure intellectual property filing and renewal deadlines are met.
  • Prepare and review license agreements, joint development agreements, non-disclosure agreements and invention assignment agreements.
  • Train engineers and others to recognize patentable inventions.
  • Examine new patents filed by competitors to determine risk and merit of filing challenges.
  • Prepare opinions and advise the corporation on infringement claims, both against third parties and against the corporation.
  • Suggest modifications to products to (1) allow for better intellectual property protection or (2) avoid interfering with intellectual property of others.
  • Keep apprised with respect to legal changes in intellectual property laws.
  • Review and comment on supplier and customer commercial agreements.
  • Support and participate in negotiations related to commercial agreements.
  • supplying pertinent intellectual property and technology transfer information for annual corporate 10-K, U.S. R&D tax credit and U.S. Department of Commerce R&D Survey submissions

QUALIFICATIONS

MINIMUM QUALIFICATIONS:

  • Juris Doctorate (J.D.)
  • Minimum of 6 years of experience 
  • Member of the Patent Bar / Registered with the Patent and Trademark Office
  • Must be a member in good standing with the State Bar of Michigan, or demonstrate ability to become a member within a short period of time, such as by reciprocity application.

PREFERRED QUALIFICATIONS:

  • Combination of outside and in-house legal experience
  • Automotive industry experience
  • Leadership experience

TRAVEL: Up to 10% global travel on an as-needed basis

LEADERSHIP RESPONSIBLITIES: Manage legal intern(s), and indirect responsibility for managing 2 IP paralegals in Europe.
